That is indeed unfortunate, and Apple has been known to make an absolute mess of CS at times, I will not deny that. In your particular case depending on what country you live in, it could still be solvable with a small claims court case or just threatening with one. Apple should notify all customers when their machine is affected by a repairs program. That is 100% on them, not you!
