Regarding the image, technically, as I mentioned in my recent article about image copyright if the HTML image tag refers to the same exact link as your article, then it technically could be considered legal. It's a bit of a grey area, if the image isn't a thumbnail. Either way, it wouldn't become your legal concern, but theirs.
